OpinionThe New York Court of Appeals held that the prosecutor's improper reference during summation to the defendant's character, which was not in evidence, was harmless. "The prosecutor's comment was uncalled for in that it made an oblique reference to defendant's character, which was not in evidence [citations omitted]. We conclude, however, that the error was harmless in light of the overwhelming evidence of defendant's guilt [citation omitted]."
