OpinionDistrict Court ordered a new trial after a plea bargain with Goldfarb's codefendents required that they not speak to Goldfarb's attorneys outside the presence of a prosecutor. "[S]uch a requirement clearly discourages cooperating defendants from candidly discussing the litigation with co-defendants or their counsel" and amounts to "prosecutorial misconduct." However, the Court later withdrew its conclusion that the "improper" plea agreements amounted to misconduct.
