OpinionDistrict Court granted a new trial after the prosecutor improperly impeached the expert witness's credibility "by having him acknowledge that he relied on an outdated edition of the [Diagnostic and Statistical Manual of Mental Disorders], which included different criteria than the 'recent' manual," when in fact the prosecutor was relying on an outdated version manual. "Here, defendant's retained expert's credibility was effectively torpedoed by an unfair and false premise, a responsibility the Government must bear, notwithstanding that it was unintentional and unknowing."
