OpinionProsecution did not disclose a plea agreement with one of its testifying witnesses to the defense. Additionally, that witness was permitted to lie on the stand when asked if he received any benefits in exchange for his testimony. The Fifth Circuit Court of Appeals reversed the conviction: "By failing to correct the misrepresentation, we find that the government violated [the defendants'] rights to due process under the Fourteenth Amendment."
