OpinionTenth Circuit Court of Appeals vacated the defendant's drug conviction due to the prosecution's failure to disclose impeachment evidence of their key informant witness. "This is a case where the agents' identification is weak at best and no physical evidence exists to link the defendant to the alleged crime. The government's near-total reliance on the testimony of the CI (confidential informant) to establish that [the defendant] was indeed the person participating in the controlled buy requires a new trial."
