OpinionRhode Island Supreme Court ordered a new trial for a man convicted of drug offenses, saying that the prosecutor in the case violated his right to a fair trial by misrepresenting his criminal history while questioning him during cross-examination. The court said that Superior Court Judge Robert D. Krause should have blocked the improper cross-examination and issued an immediate cautionary instruction to the jurors: "We are well satisfied that the three questions at issue in this case were improper and inappropriate for impeachment purposes. In particular, we are troubled by the questions concerning the nature of the offense with which defendant was previously charged. Not only did these questions place factually incorrect information before the jury, they also impermissibly introduced false evidence of defendant's previous criminal conduct."
