OpinionThe Supreme Court of New York granted the defendant a new trial in a murder case, in part, after it was revealed that the prosecution knew or should have known that a key witness gave materially false evidence at trial. Indeed, because of new evidence, the defendant was found to be actually innocent of the murder. The indictment was dismissed with prejudice by Justice John Cataldo. No new trial was ever ordered and the Manhattan's DA's office under newly-elected Cyrus Vance did not appeal Judge Cataldo's decision.
