OpinionDefendant was convicted by a jury in the District Court of Grand Forks County, North Dakota of corruption or solicitation of a minor. The Supreme Court of North Dakota held that the prosecutor's improper closing argument comment on defendant's failure to testify did not constitute harmless error and reversed his conviction: "We cannot say it is clear beyond a reasonable doubt that absent the prosecutor's improper comments the jury would have returned a verdict of guilty in this case."
