OpinionFollowing affirmance of his convictions for aggravated murder and aggravated robbery, the state prisoner filed petition for writ of habeas corpus. The District Court for the Southern District of Ohio denied his petition, and he appealed. The Sixth Circuit Court of Appeals held that: (1) state court used wrong standard in assessing petitioner's Brady claim, and (2) finding that state's failure to produce exculpatory evidence did not violate Brady was not reasonable. The prisoner's habeas claim was granted and his conviction and sentence were vacated.
