OpinionProsecutor, Tyler Larsen, was fired by the County Attorney, who accused Larsen of "attempting to obtain a criminal conviction by knowingly using tainted eyewitness testimony and not correcting the record when he had an opportunity to do" so in an aggravated robbery case. He appealed his firing and the Utah District Court set aside his termination due to the Davis County Career Service Council's consideration of additional allegations of misconduct. The Utah Court of Appeals reversed that decision, holding that "Larsen's misconduct relative to the Apadaca trial was the clear focus of Larsen's pretermination hearing, his termination letter, and his hearing before the Davis County Career Service Council. The Council held an appropriate hearing and concluded, in brief but unmistakable findings, that the charged misconduct alone warranted termination."
