Trial YearUKN
OpinionThe Arizona Supreme Court held that the prosecution made improper remarks during its closing argument constituting misconduct. The prosecution improperly vouched for its evidence by stating "everyone knows that DNA evidence is the best investigative tool around" and called into question defense counsel's integrity when he "commented about what defense counsel knew about the strength of DNA evidence." The Court stated "the overwhelming evidence of guilt influenced the jury to convict Newell rather than the prosecutor's statements about the DNA evidence and defense counsel."
