OpinionThe New York Supreme Court, Appellate Division, held the prosecutor's misconduct was harmless: "[S]ome of the prosecutor's comments involved inappropriate name calling and references, or denigrated the defense. However, the defense for the most part did not timely object and we find that the remarks were, with few exceptions, fair comment on the evidence or in response to the theory of the defense and its summation. . ."
