OpinionThe New York Supreme Court, Appellate Division, held that the prosecutor's comments that the defendant “needs a strong message” were improper but such comments were not so egregious as to deny the defendant fair trial. "We agree with defendant that the prosecutor's comments that defendant 'needs a strong message' were improper [citations omitted]. Although Supreme Court should have sustained the objection to those comments and issued prompt curative instructions [citation omitted], we nevertheless conclude that those comments were not so egregious that they denied defendant a fair trial [citation omitted]."
