OpinionThe New York County Court for Tioga County, held that dismissal of the indictment was warranted because its integrity was impaired and prejudice to the defendant could result. "The amount of hearsay evidence offered by itself was overwhelming. In addition, the prosecution improperly offered evidence of prior conduct by the defendant [citations omitted] in an attempt to show defendant's motive and 'need to control' other persons in his life, as the prosecution explained to the court during argument on pre-trial motions in this case."
